Legal Question in Family Law in Oklahoma

My husband had a stroke - I need to have access to his bank accounts and pay bills I am not a signor on his account but I have obtained a letter from the doctor declaring him permanently disabled and unable to take care of himself. What do I need to do to be able to write checks on his account.

If your husband executed a Durable Power of Attorney before his stroke, then the person appointed by him as his Attorney-in-Fact (most likely you) can use that document to act on his behalf and obtain access to his accounts. If he did not execute a DPA, then you will need to petition the District Court in the county of your residence to be appointed as his guardian. Once you have been appointed as guardian, you will have legal access to his accounts and be able to act for him to pay the bills.
