Legal Question in Family Law in Oklahoma

Incapacitated Non-Custodial Parent

I am the (mother) custodial parent. The father(non-custodial) parent has been critically injured at work and has been in ICU in a coma for 4 weeks. His prognosis is unknown. What are my legal rights regarding the financial support of my daughter or what action should I be taking at this point?

Re: Incapacitated Non-Custodial Parent

The injury is recent. However, at some point worker compensation may begin and you could receive child support payments from workers compensation. You likely would need to hire an attorney. Also, if the father were to pass, then your child may have a workers compensation claim and/or a tort claim for wrongful death depending on the circumstances of the accident. If you need an attorney, I would be happy to discuss these issues with you directly through my email listed in the footer.
