Insurance premiums

My divorce decree is out of Georgia and it stses that I must provide insurance on my daughter which I do. My ex-wife insist that i pay half of her insurance premium to. Now she wants a verbal agreement that i pay this and i won't have to pay anymore out of pocket expenses. She state that she can take me to court and get this out in Ok. I have been told she coouldn'tunless she has it changed that i don't have to carry insurance. Is she able to do this or am I liable to keep my insurance plus pay for hers that she carries? Thank you

I have not seen your divorce decree but it sounds as if you were ordered to carry insurance and perhaps pay part of anything not covered by the insurance. If so then you are in compliance with the decree. As a practical matter it could be easier for her to carry the insurance and you pay half of the premium for full family coverage. How that would releive you of paying part of the uncovered portion will depend on her coverage. Economically I dont know which would be the best way to provide coverage. A court in Oklahoma, if it had jurisdiction over the child could modify the divorce decree to do what she is recommending although I dont know if it would. Your problem would be to either fight against the Oklahoma Court having jurisdiction or the modification which would involve significant attorney fees. There is also the possibility that she could seek to modify the child support also. If she is now working and wasnt before a modification could benefit you. It could however be more. If you know her income you can go to "familiesintransition.com" and use their child support calculator to compute child support. I am not suggesting that the Oklahoma courts have jurisdiction over this matter although they may depending upon a number of factors including how long she and child have been in Oklahoma. In Oklahoma child support obligations are based in large part upon the combined gross income of the parents. Your percentage of that combined gross income determines child support. Oklahoma then follows a chart much like a tax table that tell what amount of child support is required for 1,2,3,4 or more children. Say it says child support for one child is $430. You percentage of the combined income is multiplie times the child support to arrive at your child support obligation. Then added to or subtracted from this as the case mnay be are other costs such as insurance and child care costs to arrive at your total child support obligation. I hope this helps you.
