We are currently in a joint custody situation and the other party has decided to move out of town and leave the children what rights do we have. And if her plans doesn't work out will she have the same rights as before she left?

There are a couple of issues here that you need to address. One would depend on how far she is moving. Basically you consider doing a Motion to Modify based upon her moving. That would modify (change) the court's order to allow for a workable visitation plan. And if things doesn't work and she comes back she would not have the same rights as before.
