can I leave the state of Kansas to live 30 miles south in Oklahoma?

I am wanting to get a divorce. I am afraid though that I will not be allowed to take my kids across the line of KS into OK to live where my family is located. Though it is only a short distance, it is out of state and I don't want to do anything to jeopardize getting custody, worse yet, put in jail or charged with kidnapping and making it look as though I am trying to keep him away from the kids. I am not doing that. I cannot afford to stay here without the help of family. I need someone to watch the little one while I go to work without having to pay a sitter and going to work just to pay them. I am sure you've heard it all.

Any move is reason for the court to modify custody. And you are required to provide notice via certified mail, return receipt to the non-custodial parent prior to the move. My best suggestion at this time is to attempt to work out an agreement with the other parent concerning the move. The other option would be to have a very good attorney in your corner ready to fight for you.
