paternity questions

My daughter separated from her husband a year ago and is now expecting a baby with another man. If this man does not sign the paternity papers, will my son-in-law be legally responsible for this child? Who's name will go on the birth certificate? What will the child's last name be? And, finally, does my son-in-law have any recourse?

This is not a simple question. Your daughter should file a request for child support through DHS, if the father is not living with the mother at birth. Issues of paternity, etc. will be resolved through that proceeding. If the father acknowledges paternity by signing a paternity affidavit at the hospital, he will be the legal father of the child barring unusual circumstances.
