You can always ask the judge for anything and depending on the circumstances, it may or not be approved. However, just a bit of common sense is that if the situation you describe is factual, perhaps you would be better advised to simply move on. Just because a man has the biological power to father a child, it does not bestow upon him the ability to be a father to the child.
