Legal Question in Family Law in Oklahoma
Possibility of obtaining full custody???
I have court ordered split-custody of my son with his paternal father. However I am now married (almost 2 yrs), and my husband is in the military, & has no chance of being given orders to the current state I reside in. I don't want to spend my entire life not living with my current husband, but do not want to have to give up custody of my son. We are financially and emotionally stable vs. the custodial father and his girlfriend, who have a history of debt and break-ups. I am just wondering, in the state of Oklahoma, would I have any chance of gaining full custody of my son? Or would I have to give up my custodial rights, since I am the one who would be relocating to another state?? Any information provided would be greatly appreciated.

You could argue the father is unfit and, based on that, argue the best interests of the child are to be with the stability and financial security of you and your new husband. You additionally could attempt to negotiate a compromise whereby you agree to let your son spend extended periods annually with his father (eg, summers, Xmas holidays, etc.) in return for agreeing with the relocation.
