Legal Question in Family Law in Oklahoma

QDRO on divorce

What is the usual practice on QDRO's re: a) who completes the form, Petitioner or Respondant's attorney and b) Does it have to be done at the same time as the final decree (vs. after the decree with the details of asset split up identified)?

In this case, it is only the Petitioneer's assets that are being divided, primarily at a 50% level.

Thanks for any insight you can provide.

Re: QDRO on divorce

A QDRO is normally prepared by the attorney for the party who is receiving a distribution for the retirment account. It is generally filed with the decree or after the decree is entered. It is best, however, that the QDRO is entered shortly after the Decree.
