Legal Question in Family Law in Oklahoma
Can a small inheritance be taken for back child support
On January of this year, I received a fully favorable decision from the Social Security Administration, saying that I had been ''under a disability'' since my on-the-job accident in 2000.I was awarded $331.00 a month(before taking out Medicare), going back to October 24th, 2003, when I filed.
In September 2005, I was ordered to pay $152.00 in child support. I told the judge I couldn't work and was waiting an answer about social security.Having not been approved yet, I was unable to convince him that I was disabled and he calculated the child support amount as if I was working for minimum wages. My current husband, not wanting me to get in trouble , paid it every month.
When I received my Social Security letter of awards in January, I took it to my case worker at DHSChild Support Enforcement. She then told me that she would close my case so We stop paying. Well, she misinformed me,(got fired for it), and I now owe back child support. Okay, my main question is'' I am receiving an inheritance from my deceased step-mother in the amount of $6,500 Canadian (around $5,700.00 American. Can they take part of it for back child support. I intend to use the money to move to North Carolina and go see my ailing father. Please help!

An inheritance would not be exempt from being attached. So, yes, if child support enforcement found out about the money, they could attempt to levy on it.
