Step-parent adoption

I have a 12 year old son whose father signed paternity papers 3 years ago, and has only seen him 2 times in his life. I have been married for 4 years now, my son chooses to go by his step-father's last name, but cannot legally use it at school. I have no idea the address of my son's father, or what state he is in. Does that mean that my husband can adopt my son, even though we cannot find his real father to give consent? And also, isn't there a way for us to do this by ourselves? Thank you for any info you provide.

Thank you for your question. The child may not be adopted without the natural father's consent or unless the consent is not necessary because the father's rights have been terminated. These matters can be accomplished by yourselves but I would think not without a great deal of effort and educating yourselves on the law applicable.
