Legal Question in Family Law in Oklahoma

Tribal Membership

My husband is on the Creek Roll, but only at 1/8th I think. If we adopted a Native American baby that was 100% or even 1/2 Creek, would the baby get a roll number that only says 1/16 or would he/she get the actual percentage. How does that work?

Re: Tribal Membership

For a more certain answer I suggest you consult an attorney who deals specifically in Native American law; however, my guess would be the adoption would have no effect on the adopted child's percentage. I believe the purpose of the percentage is to indicate actual amount, which is unaffected by adoptive parents. For example, if a child is known 100% Indian and is adopted by parents who have 0% Indian, the child is unchanged.
