Legal Question in Family Law in Oklahoma
Is unemployed custodial mother required to find job?
I live in Arkansas. I have two children with my previous wife. A 15yo girl which presently lives with her mother and a 17yo son that recently moved to his mothers. Their mother is a registered nurse and quit work about a year ago, but has kept her Oklahoma nursing license current. She quit work because her and her new husband had twins. Apparently she had planned to stay at home with them until the twins started school and then she was going to return to work. Now since my son has moved over there and she will be seeking child support, will she be required to go back to work or will I be paying out the wazoo while she sits at home? I know she wouldn't have any problem getting a job since there is a demand for nurses. My other question is, if she can sit at home with her babies, can I do the same? Me and my wife are expecting a baby in 4 weeks. Thanks

Re: Is unemployed custodial mother required to find job?
You stated that you live in Arkansas, does your ex live in Oklahoma? If Oklahoma has jurisdiction the Court will, when one party is unemployed, determine child support based on minimum wage, for that party. You can go to www.familiesintransition and figure the child support there. Good Luck, Bob Adcox
