My ex wife wants to take my 5 year old away if I turn out not to be his biological father. I'm on his birth certificate and have raised him for 5 years. She had an affair with her boss and had a baby and she led me on to think he was mine. After raising him for 6 months we did a DNA test and it was her bosses. I signed my rights over. She also tried to commit suicide last year before she was pregnant. If she issues a court DNA test.. and it comes back I'm not the father of our 5yr old, will i still have a say in the rights to him? The other potential father has NOT ever been a part of his life and lives in another state.

Although you are not biological father under the law you are legal father. You want to contact an attorney and make sure that your interests are protected. Generally, after a child has reached his/her second birthday paternity is set. Good Luck.
