Legal Question in Medical Leave in Oklahoma

legally required time off for fmla

i understand this act provides 12 weeks of unpaid leave after i exhaust my paid leave. is that correct? in other words, if i have been off for awhile and have exhausted all my leave, is my employer now required to provide me with 12 weeks unpaid leave?

Not necessarily. The FMLA provides for 12 weeks of unpaid leave during a 12 month period, but this unpaid leave can be made to run concurrent with paid leave. The philosophy of the law is to guarantee at least 12 weeks of leave, not necessarily to guarantee anymore than that.
