The family and Medical Leave Act of 1993, Title I, Sec. 102 (2)(B)Serious Health Condition

Can an employer deny the use of accrued paid leave and what is meant by the statement: except that nothing in this title shall require an employer to provide paid sick leave or paid medical leave in any situation which such employer would not normally provide any such paid leave?

Is the intent of the act to permit use of paid sick leave for care of a spouse?

You are not entitled to use paid sick leave to care for a spouse under the FMLA. You are entitled to use paid vacation time if it is available to you. The FMLA requires that your employer give you the time off but does not entitle you to be paid.
