Legal Question in Civil Litigation in Oklahoma

Automobile Title

I need to file an amended petition for a car title to avoid paying another filing fee because I filed the wrong type of petition. I filed a stolen/lost title petition but have the orignal title and need to file an amended petition declaring me as the owner of a vehicle because my ex removed me from the title by requesting a duplicate title. We were both on the tile with OR and not AND so she was able to remove me with the duplicate. I however have the original, proof of purchasing the car, possession of the car and am the owner of the car.

Re: Automobile Title

If you are, in fact. the true and correct owner of the vehicle and the petition was filed in error, you should request to 'VACATE' the petition filed as lost/stolen. Secondly, there's still a question of HOW your ex-wife obtained her legal authority to remove your name from the title, particularly, if she has no legal document proving her in full, legal ownership and possession of the vehicle. As such, you may want to consider having her make this correct or amendment to the 'duplicate' title to match your legal ownership of the 'original' title. Or, you should have the orginator of this so called duplicate and make him/her intitiate the corrections without a petition.
