Confession of Judgements

seeking information regarding a confession of judgement by the defendant while on the stand during a civil trial. The attorney for Plaintiff did not seek Judgement at that time and the defendant confessed to one of the plaintiff's filings while on the stand.

Thank you for your question. A confession of judgment is something that occurs in the normal course of legal proceedings prior to trial and avoids a trial. It sounds to me as if you are talking about what you feel was an admission of some facts or obligation from the witness stand. Whether the admission was suffiecient to entitle the other party to judgment would depend on what was admitted. ie. I could admit that I owe a debt but continue to defend on the theory that the debt was offset by other obligations between us or that I should have a credit against the debt etc. If you wish to read more about Offers to Confess judgment go to the following website and click on �689 and �1106.
