If an employee accuses another employee of discrimination based on race, submits only an internal complaint within the company, and the accusation is ruled to be unsubstantiated by the company investigation, can the accused employee bring a libel action against the accuser?

The accuser in this situation may claim they had a duty to report to their employer what they believed was possibly an unlawful discriminatory situation in the workplace. This may not qualify as "publishing" the alleged libelous statement. If, however, the accuser "published" to others in the office (or the employer did not maintain reasonable confidence in its investigation), and this created a hostile environment that the employer then does not address, there may be something against the employer as a result of the accuser's statement.
