Legal Question in Civil Litigation in Oklahoma

Medical Confidentality and Auto Accident

My wife's vehicle was hit in the parking lot of a medical complex. The guy didn't leave his info but the video cameras caught it on tape and several nurse's ID the guy but wouldn't release his name because of patient confidentality. They sent off the tape to the security company to see if they can clear up the picture better and we haven't heard from them since. My question is what should I do? How can I get the tape so I can get the guy? Do I go to the cops? Do I need a lawyer? We're looking at at or above $1000 in damage to the car.

Re: Medical Confidentality and Auto Accident

The first step to take is the one that won't cost you anything. Go to the police and file a criminal complaint. The police can subpoena the necessary information to identify the driver. If the police won't act(because this must be a very low priority crime for them) and if by then you have the license plate number of the other vehicle from the video, contact the Dept of Public Safety. They can suspend the vehicle owner's right to operate the vehicle. If none of this works or takes too long, go see an attorney.
