Legal Question in Civil Litigation in Oklahoma

Suit seeking judgement for unsecured debt

I am told that I have been summoned to court for a lawsuit involving an unsecured Credit Card debt. The summons was served to my son, different name, not to me. They further state they have an arbitration award which I was not notified of. Can they get a judgement? And can they attach or garnish my pay for an unsecured debt?

Re: Suit seeking judgement for unsecured debt

There are several issues here... First the summons was served to your son. Does he reside in your residence? If he does not you have grounds to have the action stopped because of lack of service. Second, you can go to www.oscn.net and check to see if there are any judgments against you. Finally, Yes, you can be garnished for an unsecured credit account. This sounds like you may need to contact an attorney for more legal advice. Good Luck, Bob Adcox
