Legal Question in Civil Litigation in Oklahoma
Violation of Due Process?
In my husand and myself's lawsuit, the judge granted a Summary Judgement motion for the opposing side not long after petition had been filed. Discovery, interrogatories, etc. had not been done. We had a strong case against the opposing side for bringing false and slanderous charges against my husband and myself in a previous case. We believe that our due process rights were violated because we did not get a fair and just hearing. Is it possible to try to pursue justice for this? Thank you.

Re: Violation of Due Process?
Thank you for your question. Disagreement with a court's decision by a losing party is pretty common. In fact probably every losing party does not feel that they got justice. Your post provides no information on what you believe occurred that deprived you of due process. Summary Judgments are not favored but are legitimate if the court was not presented with evidence showing that a controvery existed concerning a material fact at issue in the case.
