Legal Question in Health Care Law in Oklahoma
Do you need power of Attorney for medical decissions for a married couple in Oklahoma. I was told by the hospital that you do not. We have been married for 30 years

In my opinion, I would recommend that each of you should prepare a limited or specific power of attorney to deal with, when necessary, the respective spouse's medical issues at the hospital. That power of attonrey would be activated only during the period of incapacity of the spouse, if only if, that spouse is mentally incapacitated either because of an injury, serious illness or medication. This power of attonrey should end when the spouse is no longer incapacitated.
Further, the specific power of attorney may limit the rights of the spouse who would be the attorney in fact during the period of incapacity, such as control over bank accounts, investments, etc.
