marriage to someone who is not suppose to be here
I have been with some one who is not legal for some time now. He is from El Salvador. We want to get married on his 18 th birthday in Oklahoma. But we are afraid that he will get sent back. We dont know if we should go through with it. Is there anything we can do to make sure that does not happen?

The answer depends on numerous factors, such as when he entered the country, what status he entered (i.e. on a visa or illegally), etc. Depending on these factors, upon your marriage, if you are a green card holder or a U.S. citizen, you would be eligible for file a visa petition for your husband.

It is certainly possible depending no how he came in to the country and for how long. He might, however, and depending on the circumstances, be required to go back to his country first. You should contact an immigration lawyer on this before proceeding.
