Legal Question in Immigration Law in Oklahoma

Marriage to someone whose Visa has run out!!

I married a girl from Mexico who has been living here for 4 yrs. She came over on a J2 Visa with her husband (they have since divorced on June 18, 2002)and that Visa expired in March 24,2003, it was issued on June 18, 2002 as well. We were married in April of 2004, can she get another Visa? Are we a legal marriage? What is our next step? Her I-94 (connected with that Visa) has no date but says J-Z D/S last admitted on Dec. 23, 02. She has another Visa/Border Crossing Identification Card type R class BBBCC that expires on Jan. 28, 2008. We want to be able to go to Mexico but are afraid she might get held, HELP?!?!? Her Employment Authorization Card expired 01/23/01. We would appreciate any guidance

Re: Marriage to someone whose Visa has run out!!

You will want to remain in the US until you have had a chance to consult with an immigration attorney. Based upon the information you have provided, it is likely that you (assuming you are a US citizen) may apply to adjust her status. However, a full look at the situation is necessary to know for certain. If you would like to discuss this further, please contact me by telephone or email.

My best wishes.
