deductions from check

My wife works at a daycare where my daughter attends, we pay 90.00 a week for my daughter. we got behind in our payments by 4 weeks. my wife's employer took the money from her check. are they allowed to do this.

Federal law requires an ER to pay the minimum wage of $5.15/hour, and if your state has its own minimum wage law, that would apply as well. Under federal law, there wouldnt be anything unlawful about a deduction unless it caused an employee's wages to fall below the minimum wage, but your state might have a different provision. As a result, you should consult an attorney in your area.
