Legal Question in Employment Law in Oklahoma

Gifts for employee

We have an employee who just lost his home in a fire. We, as a company and fellow employees, wanted to collect money for him. He does have several child support garnishments. Is the money that we give him subject to the garnishment rule? Also, does he have to pay taxes on a money of this matter??

Re: Gifts for employee

Some questions:

Was he uninsured?

I would need to review the garnishment docs to advise, but they usually only attach to amounts OWED to the employee.

Payments (gifts to assist one's casualty loss) would clearly NOT be OWED, and were not EARNED, thus not taxable. To be absolutely safe, it might be wise to donate to Red Cross with a designation "For Benefit of Fire Victim John Smith". Etc. Call or email for further assistance.
