Legal Question in Employment Law in Oklahoma
Job Levels and pay scales implemented but not paid
Husband works for a company that implemented levels with pay scales. Husband was moved to a higher level in the company without agreeing to it and was not paid the increase of the new payscale. Husband wants to change positions which would decrease his level. Employer wants to reduce his pay along with the pay scale. Can they reduce his pay when he never got it in the first place? Also found out that all the other people that got raised levels got the pay but he did not, looks like discrimination. Husband is going to talk to the store manager and try to resolve but if not resolved, would an arbitrate or a lawsuit be an alternative? Or is he just screwed when his coworkers agree and his immediate managers agree that he got screwed? Found out the level change was about 1.5 years ago without notice which we figure would amount to about $8000 that he was never paid. What options if any are we up against.

It sounds like you may have a case. If his work is union, get in touch with the rep. If not, contact a labor law attorney in your area and run it by him/her. It depends on the employment contract as to whether arbitration or a lawsuit is appropriate.
