Legal Question in Employment Law in Oklahoma

Job Title

I am one of six draftsmen for a small woodworking company. Our titles are Project Engineer even though none of us has engineering degrees. Is this legal for the company to do? Isn't there an issue of liability if we are called Engineers?

It is unlikely you personally have any liability because of the term "engineer." If, however, your company is holding out to the public more than that, then the company could be exposed to liability in certain situations. For example, if a customer was told the individuals are "licensed engineers," leading the customer to believe that as fact, then there could be problems if the customer were to have reason to sue the company (eg, on a product liability claim).

The law is Okla. Stat. tit. 59 section 475.1, and states in part, "It shall be unlawful to practice or to offer to practice engineering or land surveying in this state, as defined in the provisions of Section 475.1 et seq. of this title, or to use in connection with any name or otherwise assume or advertise any title or description tending to convey the impression that any person is an engineer, professional engineer, land surveyor or professional land surveyor, unless such person has been duly licensed under the provisions of Section 475.1 et seq. of this title."
