Re: overtime pay
In general, unless specifically exempted, employees who are covered by the Fair Labor Standards Act must receive overtime pay for hours worked in excess of 40 in a workweek at a rate not less than time and one-half their regular rates of pay.
The Act applies on a workweek basis - seven consecutive 24-hour periods. Averaging of hours over two or more weeks is not permitted.
Keep in mind certain exceptions exist in certain industries, if you have a written agreement with your employer the rules may be different, not all employees are subject to the act, and not all employers are subject to the act.
