Vacation Time

Per the employee handbook, no where does it state that our vacation time scheduling is dependent upon our production ratio, or that we have to divide our vacation time evenly in each quarter. New manager is now telling us that these two things must happen. We are being told that if we are not productive, we cannot take our vacation time, and if we are productive, we have to divide it evenly between the quarters. For our employees to be productive, business has to come in, we have no control of the amount of business that comes in, but yet we are held ressponible for our production ratio's, even though we have a sales force.

Can they do this?

You may have an illegal practice going on here. Consult a local employment lawyer. Conditioning earned benefits on productivity doesn't sound legal. If there is a union, definitely take it to them first.
