Legal Question in Employment Law in Oklahoma
wrongful termination
I was fired from my job for allegedly calling my supervisor a nigger. I did not do this and advised them that I would take a lie detector test to prove it. My employer says they have two affidavits saying that I did and that is what they are basing the firing on. I have a lot more to the story, but I am sure you dont want the whole thing. Needless to say my supervisor does not like me and that he could not find a job performance reason to get me so he got two employees to write the affidavits. I have two questions, 1) can I sue them for defamation of character or wrongful termination? 2) How long do they have by law to pay me my final check?

Re: wrongful termination
A claim of defamation might be tough to win, and wrongful termination may also be tough if they've got people who will testify against you. It might come down to who is more believable to a jury. As for how long they have to pay you, most employers make such payments on the next regularly scheduled pay period. If they haven't you might want to call the Okla Dept. of Labor and consider a wage claim if they won't pay.
