Apartment Lease Breaking
Husband, 15 month old daughter and I moved into student graduate housing.
Before we moved in we were told several times it was a quiet area. This is why
we decided to move in. A week after we moved in the upstairs neighbor was
constantly causing problems with noise. We complained several times.
Eventually he moved over to the undergrad apartments. Now we have a new
neighbor who is even louder than the previous. He has a young child who is
running back and forth all the time and he is military and is up everyday @
6am and for 2 consecutive hrs we hear stomp! boom! bang! this rattles our
dishes wakes us up and our daughter. We are getting no sleep my husband
has missed several classes and i have failed several tests and missed quizzes
all together. The school states that we have the Right to Sleep and Study and
we arent getting any of that done. We asked to break our lease w/o having to
pay the 800.00 so we can move elsewhere. Is this possible?

I would need to review your lease and the source of the "Right to Sleep and Study".
There is no such right in common law per se.
