Legal Question in Landlord & Tenant Law in Oklahoma
Eviction
Is filing eviction against only one of the three tenants on a lease legal in Oklahoma? My apartment complex claims they never received my payment, although I did pay it and have proof. They filed eviction against me, but not against my fiancee or roommate. That seems like it should be illegal. Is it?

Re: Eviction
It's legal if the names of the fiancee or roommate is not on the lease and/or they did not sign the lease. And, if you paid the rent he/she cannot legally evict you. If you have this proof, go before a judge during her eviction.
She cannot legally evict you without a court order. So feel free to go to court with ths proof. However, this recommendationis limited as it only applies if they are evicting you for non-payment; not for other lease/tenant violations you may have failed to mention.
Either way, the Landlord can only take action against the individuals who had signed this lease agreement.
