Illegal eviction
my landlord called on aug 13th and told me to be out by sept 1 then put locks on the door on aug 23rd keeping us from our things and is now taking us to small claims court for unpaid utility bills that were in her name. but isnt willing to return our things,and gave our things to the new tenants and the new tenants have been using them, do we have a case against her

yes! a landlord may NOT use what is legally called "self help" to evict a tenant. a lawful detainer process is needed (court order) before ANY landlord can change locks and/or take possession of your personal belongings. your landlord is in CLEAR violation of these protective measures in place for you, and probably should have consulted an attorney prior to "helping him/herself" evict you without a proper court order, and especially since he/she ALSO wrongfully withheld and transferred your belongings to another without consent or legal privilege. if you would like IMMEDIATE help in receiving these personal items back and/or holding your landlord LIABLE for this injustice, contact us today.
