Late rent and Lease termination

I am the landlord. My renter pays late every month. His lease is up 09/30/06. Has informed my Agent of early termination 08/30/06. My Agent has been instructed to send letters of Failure to Pay and to start eviction process if no rent forthcomming. I am currently overseas and unavailable to preside if court is necessary. Can my Agent act in my stead? Can I sue for unpaid rent/court costs if they terminate early? How is this done? How should I proceed?

You need a local real estate atty to handle this. All paperwork can be done to designate local agent to act on your behalf.
