my neighbor that lives above me is harrassing me by purposly making loud noises,Banging,pounding stomping, dropping heavy stuff on the floor. I jump, this has been going on for a long time I complained to the apt manager, seven times,at first she told him to stopped it but he hasnt,I believe he does this on purpose cause he continue to do it, and he dont like it cause I dont speak to him anymore. can I sue the apt for allowing this after they been told of the problem and do nothing, can I break my lease because of this, can they still sue me Im a nervous wreck

Yes. But you must document theses complaints to the apartment manager by letter or in writing. You must also document or write down each time these events occur. You may also use video or a recording device. Either way, be specific. This is evidence important just in case you experience retaliation or an illegal eviction or you are forced to quit or vacant your apt due to emotional distress. You should start this documentation with the first complaint. Afterwards, the apartment manager should be allowed 10 days and no more than 30 days to resolve the problem. If the problem is not resolved, particularly, after numerous written and/or documented complaints. There is good cause to break the lease agreement due to ongoing harrassment and negated enforcements by your Landlord. Either way, be prepared to present this documentation and evidence just in case you are forced to take it to the courts by the Landlord to collect rent or you are accused of breaking the lease.
