Notice to Pay Rent or Quit

i received a notice to pay rent or quit on a property that i hadn't lived in for over two months. I turned in my keys and ended my lease legally. I sent them a letter but no response. The court clerk has also said that nothing had been filed regarding the notice. Can i go to small claims court for my security deposit or do i need to get a lawyer to resolve the notice issue first.

This situation can be resolved easily by personal contact with the property owner. What you are experiencing may be just a break in communcation or mismanagement on the part of the property owner, particularly, if you sent a letter and did'nt get a response. This may be the reason that no eviction action was taken. Somehow someone definitely had "dropped this ball" after you ended your lease and they didn't record this transaction.

We would recommend that you contact the owner of the property; not the landlord or property manager and request your deposit, particularly, if you left on good terms and you did not damage the property, which is the only cause to seize your security deposit.

Then, if you are unsuccessful, the suit is an alternative.
