rent fee late charges

Is the late charge due and payable at 12:01 am on the 5th of the month if rent has not been paid at that time? Example: rent due 1st of every month, and late fee due if rent not paid ''by'' the 5th.

Yes. By law, this time runs immediately after the beginning of the 5th which is 12:01 a.m. and if it were otherwise, the lease agreement would contain or refer to the terms "before" or "after" or "on" the 5th of the month. To get further clarification the term "by" you may want to review the definition in a dictionary.

late charges is being charged for late payments. In that case after the due date and no payment has been made there would be late charges.
