Is it legal for a ex-husband to list an ex-wife as an employee of his company so his personal libilty is paid by the company and also report to IRS as if she is an employee?

No. This is not legal. Particularly if this act is it is done with fraudent and malicious intent to misrepresent facts that lead to personal gain and it is carried out with forethought.
