Legal Question in Legal Ethics in Oklahoma
Unknown diagnosis in local paper..
My 5 mnth stopped breathing at home during a nap,me and father called ems and loaded her in ambulance still not breathing, they wouldnt let us ride along and she was only white when last we saw her! After 5 agonizing hours they finally let us see her,she had passed and she had marks, bruises that we had NOT noticed, the hospital called law inforcment and cps b4 we saw her and it was in the paper the next day,of possible internal injuries, bruising in genital area and the ME had not finished his report and to this day we stilll dont know what happened. The docotr who worked on her told us ONLY that she aspirated,he never mentioned any marks. My other 2 children are involved with cps now, were not allowed alone with them and this is in the paper when ther've been NO results as to the cause of death! Is this legal?Under hippa law?to report to a paper about what the nurse THINKS happened?Thank u in advance..

Based on the information you provided. It appear that that you may have several consitutinal and legal issues to consider but we must remain cautious in our response without more information and the 'reported" facts. I would recommend that you get a copy of all the 'written" documentation and take action to protect your constitutional rights for your sake and the protection of your children.
