Legal Question in Legal Ethics in Oklahoma

Vehicle wreck

My fiance took his truck into a tranmission shop to have it looked at, while the owner of the shop was driving it (by himself) he ran off the road and wrecked the vehicle. He said my fiance's insurance will have to pay because he let him ''borrow'' the truck. My fiance's insurance is telling him to pay the deductable and get his truck fixed if it isn't totalled. If its totalled all they can do is pay off the truck. What are his options?

Re: Vehicle wreck

If this occurred by the mechanic in the performance of his duties, for profit, and business purposes and the vehicle was surrendered to him for this purpose, the mechanic is negligible and responsible for his contributory negligence and conduct. He should also be sued for any monetary or tangible damages that occured as a result of his conduct.
