Legal Question in Medical Malpractice in Oklahoma

My 2 year old daughter went to the ER at Comanche Hospital in lawton, ok on 30 March 2011. She was admitted for pneumonia. She had on an allergy band and was told she had an allergy to penicillin. However, she was administered a drup which contained penicillin anyway which put her in respiratory distress. She was flown immediately to OU Medical Center, Oklahoma City ICU for 2 days. She is currently still in the hospital. Do I have a lawsuit against Comanche Memorial?

Based on the description of the events, you may have a medical negligence case against Commanche. Certainly, if the allergy band was clearly visible, it makes sense that the hospital should have recognized it and behaved accordingly.
