Legal Question in Medical Malpractice in Oklahoma

Breast Augmentation Nightmare

Within 2 months of having a breast

augmentation I developed

what is referred to as a ''double

bubble''. If a patient has a tight

muscle, and implants are placed

under the muscle, the surgeon

should release the muscle. My

surgeon did not do this. I paid $4400

for this surgery. After seeing him

about the problem, he advised I

would need to have a surgical

correction to release muscle. I did. I

paid $1950 for this surgery. Within 1

month of the 2nd surgery, I

developed what is referred to as

''bottoming out''. On one side, I

experience extreme discomfort and

was told by my surgeon that he

made my implant pocket too far

lateral, resulting in my left breast

falling into my armpit when I am

lying down. I do not trust the

surgeon to repair the problem. I

consulted with a new surgeon and

was quoted $11,690 to completely

repair the problem, but now the

procedure will be extremely

complicated and the possibility of

losing blood supply to the nipples is a

great possibility. I want my money

back from the surgeon. He has not

been accountable at all during this

entire ordeal and this has caused

extreme emotional distress for me.

What can I do?

Consult an attorney as soon as possible.

The previous responses to your question are accurate. You should consult a local attorney as soon as possible. You should also discuss with the second surgeon regarding his/her willingness to testify that mistakes were made and now need to be corrected. Please do not hesitate to contact our firm if you believe we may be of service. There is no charge to discuss your matter. Although no attorney - client relationship is formed until an engagement letter and contract for services is signed, all matters discussed will be kept confidential. I hope this situation is resolved quickly for you, best of luck.

Re: Breast Augmentation Nightmare

You must have the case reviewed by a competent plastic surgeon expert in the field who does this surgery and who will be willing to testify if he concludes your were the victim of malpractice. Bad outcomes do not malpractice make. It must be caused by a failure to follow the minimum standards of practice held by surgeons who practice in the field.

If you sue, you better understand that your cash back is the tip of the proverbial iceberg. You will sue for pain and suffering, the cost of all of the follow up surgeries, any loss of income caused by surgery and recovery time, loss of consortium, if you are married, etc. etc.

You should have the case reviewed by a qualified medical malpractice attorney.

You will need to consult with an Oklahoma attorney right away

Time is now an important factor. You have spent a considerable time hoping that the first MD would fix this. You need a local attorney to review the case with the statute of limitations in mind. After a certain amount of time has passed you loose forever your right to sue. That time can be extended by a continuing course of treatment with the same physician, but still you will need to discuss this with an attorney in your area right away.

Oklahoma City is only 10 or 15 miles north of you so getting a good lawyer should not be very difficult. If you would like me to help you find one please feel free to write or call. 5853195334
