Legal Question in Military Law in Oklahoma

Military Issues

I swore into the marine corps on august 8th of 08. I was supposed to ship on october 20th. I still haven't left yet. They have been telling me I am being delayed. I am getting tired of waiting. I requested a DEP discharge and they told me they couldn't do it. I have a hard time believing that. What are my options and what would happen if I didn't show at MEPS on the next date they tell me to leave on? Would it be considered AWAL? Or would they have no option but to discharge me at that point?

They have no choice but to discharge if you don't show up for basic training.

My suggestion is to put the request in writing and send it to your recruiter. If they continue to call and harass you, then I would contact the Oklahoma GI Rights Hotline for assistance. (they can be reached at www.okgirightshotline.org)

Frankly, you don't need an attorney for this. I certainly would be glad to work with you on it, but the GI Rights folks can give you the information you need and are free.

Good luck!
