Legal Question in Personal Injury in Oklahoma
Automobile Accident
I was rear ended in a auto accident and I was wondering what my rights are? Also is there a time limit? What about a settlement with the insurance company? Do I need a attorney?

If the accident was the result of someone else's negligent or intentional act (as are almost all rear end collisions) then you have the right to be compensated for any property damages and personal injuries you sustained. If you were injured, I hope you sought medical care right away. From both a treatment and settlement standpoint this can be very important.
In Oklahoma, you have 2 years from the date of the accident to either settle your claim or properly file a lawsuit.
If your injuries are significant, you will probably need an attorney to assist you and to obtain the maximum recovery. If your injuries are not that extensive, it might not be worth it to you to hire an attorney, but you should at least speak with a trusted attorney about your situation before making that decision. Most attorneys that handle these types of cases do so on a contingency basis (if no recovery then there is no fee) and would be willing to talk to you without charge before you decide whether or not to hire him or her.
Good luck and if there is anything I can help you with, please feel free to call.

Sure you have rights if you were rear ended. Should you decide to settle this on your own remember that the insurance company will always try to settle for the lowest possible amount of money. Do you have any injuries? Be sure you are completely okay before you even think about settling. You may or may not want to hire an attorney, but it would be worthwhile to find one and make an appointment and go talk to him/her.Good Luck.
