Death of responsible party in lnsurance litegation

Who is responsible in an auto insurance litegation suit when the responsible party dies prior to a settlement or actually even before the case is filed? This matter involves the loss of an automobile,substancial medical bills, and possible corrective surgery.

If you don't have a lawyer, then get one soon. You are going to need to bring a lawsuit against the estate (probably). If this is the case then you may have a very short time to do this. This varies from state to state, but because you are suing an estate, you have to often give notice to the estate and then follow up with a lawsuit if needed.
