Legal Question in Personal Injury in Oklahoma

dog bite of a tresspasser on my property

My dog bit a man, Bob, who was on my property without my permission. Bob had to enter my yard through a gate, and was told to leave the property by my tenate who was outside with the dog at the time. Bob was warned verbally to exit the property but he didn't. He was bitten, twice. Does he have a case against me? Bob is a family friend and we by hay for our horses from him. He has been told to contact me prior to comming over. He knows we have the pitt bull terrier.

He is now sueing us for the medical bills and mental suffering.

As is often the case in the law, the answer is maybe. Do you have a homeowner's insurance policy? If so, see if it has any provision for defense of such a situation. You can try to defend yourself based on a couple of theories, for example, that Bob assumed the risk when he entered, and was warned. Still, Oklahoma has recently had much press regarding pitt bull terriers, and even attempts to make special laws in that regard. You may want to consider getting an attorney to help you work through it as Oklahoma does allow victims of dog bites to bring suit.
