Legal Question in Personal Injury in Oklahoma
I received a written final offer to settle my auto accident claim. I accepted it, signed it and faxed it back to the claims adjuster. The claims adjuster contacted me and indicated he made a mistake on the amount. He wants to reduce the amount and make a counter offer.
Is my first accepted, signed offer a binding contract?

Typically, an offer, once accepted, becomes a binding contract. However, if your acceptance was not timely, or contained any "conditions" or other changes/modifications to the original offer, then the adjuster would not be bound. Also, there are some situations in which the contract would be unenforceable, such as if the adjuster's offer was clearly in error and you knew it.
