Legal Question in Real Estate Law in Oklahoma
Acquired property then a month later someone files a 100 yr lease on it
My mother willed me a 5 acre tract, it became my property Feb 14, 2001 and I filed title to it on that date.
March 28, 2001 a person with a questionable lease he wrote around my mother's signature before her death filed a 100 year lease that reads in his handwritting, I hereby lease Buffalo Valley for $1 a year for 100 years also 5 acres & trailor house at 8801 s choctaw rd for $1 a year for 100 years on the HILL joing Debbie Vanlandinghams property to the road to Gary Trammell my son# Beatrice Trammell.
Signed..arrow drawn to point to Beatrice's name.
The lease is dated 1997, .
Is it not OK law that he can't file a document as such against a property after it belongs to someone else? The property owner then has full ownership correct? His claim is worthless even if it were valid? The actual 'lease' is in several different ink colors, the document was altered after it was 'notarized'.

Thanks for your question. The facts you point out are very stange and suspicious. Yet if the lease has been filed, it is an matter which will need to be cleared up before you can effectively sell it. I would suggest you talk with a local attorney about a quiet title action to remove the purported lease.
